Terms of service

I. Scope

All deliveries are made exclusively on the basis of these Terms and Conditions, which shall also apply as a framework agreement to all future legal transactions between the contracting parties. In the event of typographical, printing, or calculation errors on our websites, we are entitled to withdraw from the respective contract conclusion. All offers are non binding and valid while stocks last. Alcoholic beverages are sold exclusively to persons aged 18 or older. The legally binding contract language is German.

II. Prices

Prices are stated in euros per bottle (please note the bottle size). Prices include all statutory duties and taxes for Austria. When shipping to countries that levy excise duties or similar charges, the customer is responsible for declaring the goods and paying the applicable taxes.

III. Payment Terms

Customer payments shall be deemed made only once they have been received in our business bank account.

IV. Withdrawal from the Contract

Private customers may withdraw from their orders within 14 days. In the event of withdrawal, a full or partial refund of the purchase price will only be made upon return of the goods received by the customer. The goods must be returned unused, in a resalable condition as new, and in the original packaging. The cost of return shipping is borne by the customer.

V. Reminder Fees and Collection Costs

In the event of default, the customer undertakes to reimburse the creditor for reminder and debt collection costs incurred insofar as they are necessary for appropriate legal enforcement. The customer specifically undertakes to reimburse the fees of the engaged debt collection agency up to the maximum permitted. If the creditor handles reminders internally, the customer undertakes to pay EUR 10.00 per reminder issued and EUR 5.00 per half year for maintaining records of the outstanding debt within the reminder process.

VI. Delivery, Transport, Delay in Acceptance

Our selling prices include delivery costs within Austria for orders with a goods value of EUR 99.00 or more. For EU countries, the country surcharge per carton is stated in the order. From EUR 220.00, deliveries to Germany, the Netherlands, Slovakia, Liechtenstein, Luxembourg, Slovenia, and Hungary are also free of shipping charges. For other EU countries and for countries outside the EU, as well as for EU countries that do not permit direct private delivery of alcoholic beverages, we will contact the customer personally to agree on any special arrangements. Orders consisting exclusively of grape juice are also subject to a separate arrangement, as actual shipping costs to some countries could exceed the value of the goods. In both cases, the order becomes binding for us only after we have returned an order confirmation to the customer, taking into account the handling of shipping costs.

VII. Delivery Period

The stated delivery times are non binding and may be exceeded by up to two weeks due to unforeseeable events. Only after this period has elapsed may the customer withdraw from the order or the contract by setting a reasonable grace period.

VIII. Place of Performance

The place of performance is the registered office of our company: A-7123 Mönchhof, Austria.

IX. Damages, Transport Damage

No compensation can be provided for cork tainted wines in accordance with internationally customary conditions. If a cork tainted wine is reported in writing, the buyer may return identical wines from the same delivery, in original packaging, within 10 days of delivery at their own expense. All other claims for damages are excluded. Transport damage must be confirmed by the transport company by the customer and reported to us in writing without delay within 3 calendar days. Within this period, we can claim full compensation through insurance and either deliver replacement goods or refund the purchase price. Please do not exceed this deadline. Complaints made at a later date cannot be accepted.

X. Product Liability

Claims for recourse within the meaning of Section 12 of the Product Liability Act are excluded unless the party entitled to recourse proves that the defect was caused within our sphere and was at least the result of gross negligence.

XI. Retention of Title and Enforcement

All goods are delivered under retention of title and remain our property until full payment has been made. In the event of a return of goods, we are entitled to charge any transport and handling costs incurred.

XII. Governing Law, Jurisdiction

Austrian law shall apply. The applicability of the UN Convention on Contracts for the International Sale of Goods is expressly excluded. The buyer and the contracting parties agree to Austrian domestic jurisdiction, with the place of jurisdiction being A-7100 Neusiedl am See.
