General Terms and Conditions (GTC)
I. Validity
Deliveries are made exclusively on the basis of these terms and conditions, which also serve as a framework agreement for all further legal transactions between the contracting parties. In the event of typing, printing, or calculation errors on our websites, we reserve the right to withdraw from the respective transaction.
All our offers are non-binding and valid while stocks last. Alcoholic beverages are sold exclusively to persons aged 18 and over. The legally valid contract language is German.
II. Prices
Prices are in Euros per bottle (please note bottle size!). Prices include all statutory duties and taxes for Austria! For shipments to countries with excise duties or similar, the customer is responsible for registering the goods and paying the taxes.
III. Payment Terms
Payments from the customer are only considered made upon receipt in our business account.
IV. Contract Withdrawal
Private customers have the option to withdraw from their orders within 14 days. In the event of withdrawal, a full or partial refund of the purchase price will only take place concurrently with the return of the goods received from the customer. The goods must be returned unused, in a condition suitable for resale as new, and in their original packaging. The costs of return shipment are borne by the customer.
If a product is unavailable, the sender may specify an equivalent or higher-quality product from the same taste category as a substitute. This applies in particular to the subsequent vintage and wines of the same color and quality level.
V. Dunning and Collection Fees
In the event of default, the contracting party (customer) undertakes to reimburse the creditor for the dunning and collection fees incurred, insofar as they are necessary for appropriate legal prosecution, and in particular undertakes to reimburse a maximum of the fees of the engaged collection agency. If the creditor handles the dunning process himself, the debtor undertakes to pay an amount of EUR 10.00 per dunning notice issued and an amount of EUR 5.00 per half-year for keeping records of the debtor-creditor relationship in the dunning process.
VI. Delivery, Transport, Default of Acceptance
Our sales prices include delivery costs within Austria for goods values of EUR 72.00 or more! For EU countries, the country surcharge per carton will be listed on the order. Deliveries to Germany are also free of charge for orders of EUR 216.00 or more. For countries outside the EU or EU countries that do not allow direct private delivery of alcoholic beverages, the customer will be contacted personally by us to agree on any special arrangements. Orders for grape juice exclusively also require a separate arrangement, as the actual shipping costs to some countries could exceed the value of the goods. In both cases, the order is only considered binding for us after we have returned an order confirmation to the customer, taking into account the handling of shipping costs.
VII. Delivery Period
The stated delivery periods are non-binding and may be exceeded by up to two weeks due to unforeseeable events. Only after this period has expired can the customer withdraw from the order or contract after setting a reasonable grace period.

IX. Damages, Transport Damages
No compensation can be provided for corked wines in accordance with international customary conditions. In the event of a written complaint about a corked wine, the buyer may return identical, originally packaged wines from the same delivery within 10 days of delivery at his own expense. All other claims for damages are excluded.
*_Transport damages must be confirmed by the transport company by the customer_* and submitted in writing without delay within 3 calendar days. We can then, within this period, claim full compensation through insurance and redeliver the goods to you or refund the amount. Please do not exceed this deadline! Complaints at a later date cannot be accepted.
X. Product Liability
Recourse claims within the meaning of § 12 of the Product Liability Act are excluded, unless the recourse claimant proves that the defect was caused in our sphere and at least grossly negligently.
XI. Retention of Title and its Enforcement
All goods delivered by us remain our property until full payment has been received. In the event of goods being returned, we are entitled to charge for any transport and handling costs incurred.
XII. Choice of Law, Jurisdiction
Austrian law applies. The applicability of the UN Convention on Contracts for the International Sale of Goods is expressly excluded. The buyer or the contracting parties agree on Austrian, domestic jurisdiction, court of jurisdiction A-7100 Neusiedl/See.
