General Terms and Conditions (GTC)

I. Validity

Deliveries are made exclusively on the basis of these terms and conditions, which also serve as a framework agreement for all further legal transactions between the contracting parties. In the event of typographical, printing, or calculation errors on our websites, we reserve the right to withdraw from the respective transaction.
All our offers are non-binding and valid while stocks last. Alcoholic beverages are sold exclusively to persons 18 years of age and older. The legally binding contract language is "German."

II. Prices

Prices are in euros per bottle (please note the bottle size!). Prices include all statutory duties and taxes for Austria! For shipments to countries with excise taxes or similar, the customer is responsible for registering the goods and paying the applicable taxes.

III. Terms of payment

Payments from the customer are only considered made when they are received in our business account.

IV. Withdrawal from the contract

Private customers have the option to cancel their orders within 14 days. In the event of cancellation, a full or partial refund of the purchase price will only be made in exchange for the return of the goods received by the customer. The goods must be returned unused and in a resalable, new condition, and in their original packaging. The return shipping costs are borne by the customer.

V. Reminder and collection fees

In the event of default, the contractual partner (customer) undertakes to reimburse the creditor for reminder and collection fees incurred, insofar as they are necessary for effective legal action. In particular, the contractual partner (customer) undertakes to reimburse a maximum of the fees charged by the debt collection agency involved. If the creditor manages the dunning process itself, the debtor undertakes to pay an amount of EUR 10.00 for each reminder issued and an amount of EUR 5.00 per half year for maintaining records of the debt relationship in the dunning process.

VI. Delivery, transport, default of acceptance

Our sales prices include delivery costs within Austria for orders over EUR 72.00! For EU countries, the country surcharge per carton will be stated on the order. Deliveries to Germany are also free of charge for orders over EUR 216.00. For countries outside the EU, or for EU countries that do not allow direct private delivery of alcoholic beverages, we will contact the customer personally to agree on any special arrangements. Orders for grape juice only also require separate arrangements, as the actual shipping costs to some countries may exceed the value of the goods. In both cases, the order is only considered binding for us after we have returned an order confirmation to the customer, taking into account the handling of shipping costs.

VII. Delivery period

The stated delivery times are non-binding and may be exceeded by up to two weeks due to unforeseeable events. Only after this period has expired, after setting a reasonable grace period, can the customer withdraw from the order or the contract.

IX. Compensation, transport damage

According to international practice, no replacement can be provided for cork-tainted wines. In the event of a written complaint regarding cork-tainted wine, the buyer may return identical, originally packaged wines from the same delivery at their own expense within 10 days of delivery. All other claims for damages are excluded.
*_Transport damage must be confirmed by the transport company by the customer_* and reported immediately in writing within 3 calendar days. We can then claim full compensation through insurance within this period and either resend the goods to you or refund you. Please do not exceed this deadline! Complaints submitted after this date cannot be accepted.

X. Product liability

Recourse claims within the meaning of Section 12 of the Product Liability Act are excluded unless the party entitled to recourse proves that the defect was caused in our sphere of influence and was at least due to gross negligence.

XI. Retention of title and its enforcement

All goods are delivered by us subject to retention of title and remain our property until full payment is received. Upon return of goods, we reserve the right to charge any transport and handling costs incurred.

XII. Choice of law, place of jurisdiction

Austrian law applies. The applicability of the UN Convention on Contracts for the International Sale of Goods is expressly excluded. The buyer or the contracting parties agree to submit to Austrian domestic jurisdiction, with the place of jurisdiction being A-7100 Neusiedl/See.
